Summary Judgement Order in Adams v. Johnson & Johnson

On May 7, 20009, the Federal District Court for the Southern District of Illinois denied in part and granted in part a motion for summary judgment filed by the defendants in a wrongful death case alleged to have been caused by a defective Duragesic pain patch.  The Duragesic pain patch is designed to provide a controlled dose of fentanyl to the patient.  In the Adams case, a 48 year old man was found dead with a fentanyl blood level of 12.2 ng/ml.  According to the package insert, the patch was to provide a fentanyl level of 1.7 ng/ml.  The trial court noted that the fentanyl patch delivered a dose of fentanyl seven times greater than it should have and questions of fact remained for the jury.  Here is a copy of the order.
